All appeals are dismissed.

The grounds of appeal are examined.

1. Examining the reasoning of the lower judgment on the grounds of appeal by the Defendant in light of the evidence duly admitted by the lower court, the lower court was justifiable to have convicted the Defendant of the facts charged in this case except for the part not guilty on the grounds indicated in its reasoning. In so doing, the lower court did not err by exceeding the bounds of the principle of free evaluation of evidence

2. According to the reasoning of the lower judgment as to the prosecutor’s grounds of appeal, the lower court acquitted the prosecutor on the charges of this case on the grounds that there is no evidence of crime, except the guilty portion.

The judgment below

In light of the records, the above determination by the court below is just, and there is no error in the misapprehension of legal principles as to property interests in fraud.

On the other hand, although the prosecutor submitted a written appeal to the effect that he is dissatisfied with the entire judgment of the court below, he did not submit the grounds for appeal.

3. Therefore, all appeals are dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
