피고인은 2013. 10. 02. 23:00경 의정부시 B 소재 피해자 C(27세, 여)가 운영하는 ‘D’ 주점 내에 손님으로 들어가 술에 취하여 주방 내에 있던 튀김 기름과 그릇을 엎고, “씨발년, 내가 너와 너의 남편의 배를 짼다."라고 소리를 지르며 욕설을 하고, 자신이 앉았던 테이블 위에 있던 접시 및 음식을 양손으로 쓸어 바닥에 떨어뜨리고, 재떨이를 거꾸로 엎고 바닥에 음식을 뱉으며 소란을 피워 손님들로 하여금 그 곳을 떠나게 하는 등 다음날 00:30경까지 1시간 30분가량 위력으로써 피해자의 주점 업무를 방해하였다.
