1. All of the plaintiff's claims are dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Basic facts
A. The Plaintiff and the Defendant were established around December 29, 1965 and run passenger transport business, etc. using buses with about 240 full time workers. The Plaintiff was employed by the Defendant on September 8, 2010 and served as an urban bus driver.
B. On July 30, 2014, the Defendant held a disciplinary committee against the Plaintiff on July 30, 2014 (hereinafter “the primary disciplinary action”). Around June 16, 2014, the Defendant determined ten days’ suspension of attendance due to three non-stopted civil petitions on June 20, 2014, and notified the Plaintiff of the decision. On August 7, 2014, the Plaintiff made a request for reexamination on the above disciplinary action. On September 24, 2014, the Defendant held a new disciplinary committee and notified the Plaintiff of the following matters. On September 1, 2014, the Defendant again determined that it would be postponed through questioning between the disciplinary committee and the person under disciplinary action (the Plaintiff) and the person under disciplinary action (the Plaintiff). However, the first instance court reversed the first instance judgment, which is not an invalidation disposition, and thereafter notified the Plaintiff of the result of a new disciplinary action by the disciplinary committee’s reply to the first instance court’s decision to be 10 days’ request for reexamination.
Accordingly, on November 10, 2014, the Plaintiff filed an application for reexamination again, and the Defendant made the Review Disciplinary Committee on January 22, 2015.
