1. Of the lands listed in paragraph 1 of the attached list, the attached sheet indicating 84, 85, 86, 87, 87, 88, 89, 90, 91, 92, 93, 94, 95, 96, and 96.
Reasons
1. The following facts may be found either in dispute between the parties or in full view of Gap evidence Nos. 3 through 10, 19, 24, 25, 27, 32, 33, and 34 (including paper numbers), Eul evidence Nos. 1 through 7, 9, and 10 (including paper numbers), the results of the on-site inspection by this Court, and the entire purport of the pleadings.
On January 5, 2004, the plaintiff was donated to Gwangju City D 377m2 located at Jung-gu, Gwangju Metropolitan City, and the same year.
1. 8. The Plaintiff is the land owner who completed the registration of ownership transfer in the future.

The defendant is the owner of each land listed in the separate sheet on March 5, 2009 and buildings on the land listed in the Gwangju City E and the land listed in the separate sheet No. 3 of the attached sheet on February 25, 2009 and completed the registration of ownership transfer in the future of the defendant on the ground of successful bid dated February 25, 2009
C. At the time of the Defendant’s acquisition of each land listed in the separate sheet, through the land listed in paragraph 2 of the separate sheet, the land listed in paragraph 1 of the separate sheet was passed along the land listed in paragraph 2 of the separate sheet, and the agricultural machinery connected to G was passed around the boundary line of the land listed in paragraph 1 of the separate sheet, and the Defendant constructed a retaining wall on the south-east boundary line of the land listed in paragraphs 1 and 2 of the separate sheet, and used the land listed in the separate sheet for the site of the building on the land listed in paragraph 3 of the separate sheet and its adjacent garden or farm, and terminated the above passage.
The Plaintiff’s land is a development restriction zone under the Act on Special Measures for Designation and Management of Development Restriction Zones, and is a nature conservation zone and a Do park under the Natural Parks Act.
E. Between the Plaintiff’s land and public service, as indicated in the “Status of Passage”; however, there is no contribution to connect H, which is a contribution to the Plaintiff’s land and public service; considering the gradient, surrounding trees, and the width of the road, the agricultural machinery passes along.
