A defendant shall be punished by imprisonment with prison labor for twelve years.

Punishment of the crime

Around October 2014, the Defendant got a divorce by agreement between the victim E (n, 55 years old) and tax issues, but in fact, the Defendant was able to become a member of his/her own name due to bad credit due to the failure to pay the said tax, etc., and thereby, became subject to heavy restrictions on economic activities. Due to these problems, disputes with the victim became vacant, and the Defendant was able to ignore himself/herself while drinking alcohol.

1. 폭행 피고인은 2016. 4. 23. 19:09경 서울시 성북구 F, 지하에 있는 G주점에서, 이른바 함바식당을 동업하는 H 및 피해자와 함께 술을 마시던 중 피해자에게 이전에 자신에게 사기 범행을 저질렀다고 지목한 I를 위 함바식당에 더 이상 오지 못하게 하라고 말하였으나, 피해자로부터 “당신 친구이니, 당신이 먼저 얘기 해야지, 내가 할 수 없지 않느냐”라는 말을 듣게 되자 피해자에게 “씹할 년아! 네가 씹 대줬잖아”라고 욕설을 하면서 다투다가 피해자로부터 “꼴값하고 자빠졌네”라는 말을 듣자 격분하여 자신이 벗어놓은 점퍼를 집어들고 피해자의 몸통을 3회 가량 때리는 등 폭행하였다.
