Reasons
Punishment of the crime
No one may open a mobile communications terminal device in another person’s name and use the mobile communications service provided for the mobile communications terminal device, or commit any act to recover the relevant fund. However, from August 2016, the Defendant conspired with D, E, F, G (G from October 2016 to take part in the crime), D seeks a person who reduces the opening name of the mobile communications terminal device through Internet advertisement, etc., E and F have paid 4-50,000 won in return for the provision of the name to the provider in the name of the name, and opened the prepaid chip in the name of that person (hereinafter “large-depth chip”), and the Defendant sold the large-depth chip by inviting persons to purchase the large-depth chip through the Internet, etc., and D acquired profits by sharing the roles of supplying the account and packaging the distribution of the sales proceeds paid to the large chip.
D Around November 2016, “I” operated by H in Daegu-gu, Daegu-gu, intended to borrow the name of the court room under the condition of payment for the advertisement reported to J. In return, E and F paid 4-50,000 won to J, one prepaid chip in the name of J. On November 17, 2016, the Defendant received KRW 100,000 from K and sold the said large chip to K. From August 201 to March 2017, 2016, the Defendant opened a mobile communication device in the name of another person under the condition of selling a total of 1,075 large chis and providing funds.
