1. Of the judgment of the court of first instance, the money that orders payment from the following to the principal lawsuit is corresponding to the plaintiff (Counterclaim defendant).

1. Basic facts
가. 피고 보조참가인(이하 ‘보조참가인’이라 한다)은 2013. 2.경 LCD GLASS 식각(蝕刻, Etching) 시스템에 관하여 ‘2013. 6. 30. 제작 완료, 2013. 7. 31. 설치(SET-UP) 완료’ 계획을 세운 다음, 2013. 4.경 피고(2016. 9. 9. 변경 전 상호: B 주식회사)와 LCD GLASS 식각 시스템의 제작 및 설치를 '보조참가인은 피고에게 도급하고, 피고는 원고에게 하도급하기'로 하였고, 피고는 2013. 4. 24. 원고에게 아래 기재와 같은 내용의 LCD GLASS 식각 시스템에 관한 구매의향서를 제시하였다.
