Defendant shall be punished by a fine of KRW 5,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

On August 22, 2013, at around 21:20 on August 22, 2013, the Defendant, after drinking alcohol at an infinite restaurant located in Jinju-si, was inspected by a slope G, etc. belonging to the Jinju Police Station in front of the E Public Security Center located in D, and was discovered to be suspected of drinking alcohol driving.

피고인은 단속 경찰관이 피고인의 운전행위를 확인하였고, 피고인의 입에서 술 냄새가 나고, 걸을 때 약간 비틀거리며, 말을 할 때 발음이 부정확 하는 등 술을 마시고 운전하였다고 의심할 만한 상당한 이유가 있어 같은 날 21:34경부터 22:11경까지 진주경찰서 E치안센터에서 30분 이상에 걸쳐 위 경찰관 등으로부터 호흡측정기에 의한 음주측정을 요구받았으나 음주측정기에 입김을 불어넣는 시늉만 할 뿐 정당한 이유 없이 경찰공무원의 음주측정 요구에 응하지 아니하였다.
