A defendant shall be punished by imprisonment for not less than eight months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.

Punishment of the crime
[2014 Highest 2508] Around May 22, 2014, the Defendant made a false statement that he/she would send 1.50,000 won to the victim D, who reported and contacted with the Internet, by accessing NAVV Kaca in his/her residence in Kimhae-si, by using the Internet, posted a letter to sell NAV Kaca, a cell phone on the bulletin board, and wired 1.50,000 won to D.
However, the defendant did not have the intention or ability to sell because he/she thought that he/she received the payment from the victim and used it as living expenses, etc.
Nevertheless, the Defendant, by deceiving the victim as above, received KRW 150,000 from the victim to the bank account under the name of the Defendant on the same day, and received from August 31, 2014 a total of 5,40,000 won from that time, from August 31, 2014.
[2014 Highest 2677] On November 16, 2013, the Defendant posted a false statement to the victim E, who reported and contacted the above writing, that he would sell the above panty sports to 29,500 won by accessing the Internet NAV in a French place located in the Ma-gu, Manam-si, Sungnam-si.
However, the defendant did not have the above panty sports so that he did not have the intention or ability to sell panty sports to the victim.
Nevertheless, the Defendant, by deceiving the victim as above, received 29,500 won as sales proceeds from the national bank account in the name of the Defendant on the same day from the victim to the national bank account in the name of the Defendant.
[2014 Highest 2810] On April 26, 2014, the Defendant sent the above mobile phone to the victim F who reported the fact that he/she had access to the Defendant’s residence located in Kimhae-si, Kimhae-si, by means of the Internet, posted a notice on the website that he/she sold a mobile phone (beber6) on the bulletin board, and then remitted the price of KRW 130,000 to the victim F.
