피고인은 2013. 10. 18. 06:21경 원주시 D에 있는 피고인의 주거지에서, 스마트폰 어플리케이션 카카오톡에 개설된 대화자 640명이 참가한 단체 채팅방 ‘2번’ 내에서, 피해자 E가 '쓰꼴(수구꼴통의 줄임말)에게 내가 뭘 더바래ㅋㅋㅋ'라는 글을 게시하자 피해자에게 “어디다 훈계야 미친 개자슥아”, “빨갱이 습성 미친 새꺄”라는 내용의 글을 게시하여 공연히 피해자를 모욕하였다.
