피고인은 2013. 10. 30. 06:37경 강원 횡성군 C에 있는 본인의 집에서, 피해자 D가 평소 카카오톡 단체 채팅방에 피고인과 정반대의 정치적 성향의 글을 올리는 것에 불만을 품고, 회원수 488명인 카카오톡 채팅방 ‘E’ 게시판에 “여기 발가벗은 D, 옷 벗고 방방 뛰는 놈이 바로 D입니다^”라는 내용으로 불특정 다수의 회원들이 볼 수 있도록 게시하여 공연히 피해자를 모욕한 것을 비롯하여 별지 범죄일람표 기재와 같이 총 6회에 걸쳐 카카오톡 채팅방 게시판을 통해 공연히 피해자를 모욕하였다.
