1. Of the instant lawsuit, the Defendant, including the Plaintiff, shall not represent the residents of Ulsan-gun B, Ulsan-gun.

Basic Facts

Ulsan-gun Group B consists of 10 Ri, such as C, and approximately 8,770 persons live in it.

The Plaintiff is the head of Ulsan-gun, Ulsan-gun, and the Defendant is an organization that formed the articles of association by gathering 21 representatives of the village, B youth association, B women's association, and B Saemaul Association, etc. in the process of discussing the attraction of 5-6 units of the reported nuclear power plant around 2010.

The defendant's articles of incorporation was amended on December 2014, and the contents relating to the qualification of members and the election of officers are as follows.

Article 1 (Name) This Council shall be referred to as "B Resident Council."

Article 3 (Purpose) The purpose of this Council is to contribute to the balanced development of regions and the improvement of the quality of life by gathering uniform intentions and implementing them efficiently with respect to common matters related to the life of members as residents' organizations B.

Article 6 (Composition) This Section shall be composed of members as provided for in Article 7.

Article 7 (Qualifications for Members) The resident registration shall be registered in B and shall be the head of a household who resides in the office.

Article 9 (Rights of Members) (1) Members shall have the right to speak and vote at a general meeting, and shall have the right to vote and to be elected by officers.

(2) Members may ask questions and suggestions with respect to the operation of this session and request perusal of the articles of association, the list of members, the minutes of the general meeting, the minutes of the board of directors and the settlement of accounts.

Article 14 (Number of Officers) The kinds and the fixed number of officers shall be as follows:

1. One chairman;

2. Two vice-chairpersons;

3. Three directors; and

4. Two auditors (Election of Officers) shall be elected in accordance with the following subparagraphs:

(1) The Chairperson.

1. Delegate election system shall be adopted at the Assembly of Representatives;

2. The election commission shall administer and supervise the above paragraph (1);

3. When a person is found to fall as a candidate for the chairperson, he/she shall not be an executive for two years.

(2) Vice-chairpersons.

1. One person shall be elected by each of the Gus in which the president is not assigned, and shall be approved by the Assembly.
