A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. Injury;

A. 나. 피고인은 2013. 1. 27. 오후 피해자가 점심밥을 잘 먹지 않고 되새김질을 한다는 이유로 무릎 꿇고 벽을 보고 있으라고 벌을 세운 후 손바닥으로 피해자의 뺨을 1회 때리고 양 주먹으로 가슴을 수회 쳐 피해자의 입술이 찢어지게 하는 등 상해를 가하고, 계속하여 피해자가 화장대 위에 올라가 내려오지 않는다는 이유로 피해자를 끌어내려 양 주먹으로 피해자의 가슴을 수회 치고, 다시 피해자를 혼내기 위해 바닥에 앉힌 다음 “엄마 이름이 뭐냐”고 물었을 때 피해자가 “아리이모”(피고인이 키우는 강아지 이름이 ‘아리’임)라고 대답하고, “아빠 이름이 뭐냐”고 물었을 때 “돈 버는 기계”라고 대답한다는 이유로 손바닥으로 피해자의 뺨을 수회 때리고, 피해자가 뺨을 맞았음에도 대답을 바꾸지 않자 피해자를 발로 걷어차 바닥에 쓰러트린 다음 발로 온몸을 수회 짓밟고, 주먹으로 온몸을 수회 때리고, 피해자의 양팔을 가슴 앞에서 팔짱끼듯 엇갈리게 하고 뒤에서 팔을 꺾어 세게 잡아당겨 피해자에게 치료일수 불상의 다발성 골절상(양팔, 우측 다리, 늑골 등 골절), 폐, 간, 신장 등 내부 장기 손상, 전신 타박상 등을 가하였다.

2. No person who violates the Child Welfare Act shall commit any emotional abuse that causes damage to the body of a child, or that causes damage to the mental health and development of a child;
