The prosecutor's appeal is dismissed.

Summary of Grounds for Appeal

The sentence of the lower court (fines 5,000,000) is too unhued and unreasonable.

The crime of this case was committed by the Defendant at the center of the E University, resulting in theft of another person’s articles, and then intruded into the above reading room, and the Defendant went to with one 1,80,000 won or more at the market price of the victim on his book. The Defendant again committed the crime of this case during the suspension of execution due to the same kind of night structure, intrusion on a structure at night, larceny, and larceny. The crime of this case was committed in the same manner as the place where the crime of this case was committed, and was committed in the same way as the place where the crime was committed.

However, in light of the following: (a) the amount of damage is small amount; (b) the damaged goods were temporarily returned and the damaged goods were restored; (c) the Defendant recognized the instant crime; and (d) there is no record of criminal disposition other than the aforementioned night structure intrusion larceny; and (b) the Defendant has been working in the office or house after the pronouncement of the lower judgment and has been working in the electric workplace and has been seeking a stable life; (c) the circumstances favorable to the Defendant have been recognized; and (d) other circumstances, such as the Defendant’s age, character and conduct, environment, motive for the crime, circumstances after the crime, etc., and the sentencing conditions specified in the instant records and arguments, are considered as unreasonable.

Therefore, prosecutor's assertion is without merit.

3. In conclusion, the prosecutor's appeal is dismissed in accordance with Article 364 (4) of the Criminal Procedure Act on the ground that it is without merit. It is so decided as per Disposition.
