A and Defendant B, as a member of the telephone financial fraud organization of the People’s Republic of China’s Republic of China’s nationality, shared the role of “D” with a single book, counselor, head of passbook recruitment book, withdrawal book, etc. as a member of the telephone financial fraud organization of the People’s Republic of China’s Republic of China, followed by allowing a large number of unspecified victims to transfer money from the bank account of the victim’s financial company to the bank account of the victim by means of the victim’s transfer of money from the bank account to the bank account of the victim, or by finding out the financial information that can directly transfer money from the bank account of the victim’s name through Internet banking, and then to receive money by cash withdrawal. From May 2, 2013, the Defendants were to have the victim receive Kwikkset and cash card, and to take charge of money wired from the bank account in the name of the victim’s name by withdrawing the money from the bank account in the name of the victim.
On June 5, 2013, at around 10:40, the personnel in charge of the singinging of names made a false statement to the victim E (the age of 45) using an Internet telephone to “F sing out, and if the school wants to take care of children, all the money in the passbook are transferred to the bank.” The employee in charge of the singing of names made a false statement to the victim at around 11:39 of the same day, 2.5 million won at around 11:52 of the same day, 12:24 of the same day, and 2 million won at the account in the name of G Bank.
The Defendants received the order from one-person D to withdraw in cash the above remittance amount from 11:42 on the same day to 1:55 on the same day, and KRW 3.5 million on the aggregate from the point of origin of the new bank from 11:42 on the same day.
