1. Facts of recognition;

A. From August 2014 to December 2014, Plaintiff A resided in the H School I Center located in Yangyang-gun G (hereinafter “H school”). At the time, Plaintiff A was a student who was enrolled in the fourth grade of an elementary school at the age of 11,00, and Nonparty J was a student who was enrolled in the above H school at the same time with Plaintiff A and resided in the said H school at the age of 12 years at that time.

J은 2014. 8. 일자불상 22:00경 H학교 2층 숙소에서 보온물병으로 원고 A의 머리를 16대 때려 폭행하고, 2014. 10. 20.경 일과 후 원고 A에게 유럽여행을 가지 말라며 손바닥으로 원고 A의 뺨을 6대 때리고 벽에 밀쳐 머리를 부딪히게 하는 폭행을 하고, 2014. 11.경 일과 후 H학교 2층 숙소에서 카메라 삼각대 알루미늄파이프로 원고 A의 머리, 엉덩이, 발바닥, 손바닥을 수차례 폭행하고, 2014. 11. 중순경 일과 후 H학교 2층 숙소에서 뾰족한 연필로 원고 A의 발바닥을 수회 찌르는 폭행을 하고, 2014. 12. 초경 H학교 1층 숙소에서 원고 A이 말을 듣지 않는다며 단소로 머리, 배, 엉덩이, 발바닥을 수회 때려 폭행하고, 2014. 12.경 일과 후 H학교 2층 숙소에서 전기장판을 고온으로 올린 후 원고 A의 손을 전기장판 위에 올려놓게 하는 폭행을 하는 등 원고 A을 상습적으로 폭행(이하 ‘이 사건 상습폭행’이라 한다)하였다. 라.
