Reasons
1. Basic facts
A. The relation 1) The Plaintiff is a foundation C (hereinafter “Nonindicted Foundation”) on August 24, 1981.
(C) The park cemetery located in Gwangju-si and the non-party foundation owned is 1,476 square meters (hereinafter “C”).
(1) Of the 45 square meters (148.5 square meters, hereinafter “the instant grave site”)
After entering into a contract on the use of the cemetery, three tombstones for the Plaintiff, grandparents, and their parents (hereinafter “the grave of this case”) in the cemetery of this case.

나. 이 사건 묘역의 형상과 분묘의 배치 등 1) 이 사건 묘역은 그 아래쪽에서 정면으로 바라보았을 때 세로로 다소 긴 직사각형 모양으로, 그 오른쪽 면은 C의 입구부터 이어진 내부 도로에 접해 있고, 그 왼쪽 및 위아래의 각 면은 모두 제3자들이 설치한 분묘 묘역들과 접해 있다. 이 사건 묘역 중 위쪽 왼편에 원고의 증조부모 합장묘, 위쪽 오른편에 조부모 합장묘, 증조부모 묘 아래에 부모 합장묘가 각 위치해 있고, 각 분묘 앞에는 상석과 비석이 놓여 있다. 2) 이 사건 묘역의 둘레(아래쪽 제외)에는 반달 모양으로 토성을 두둑하게 둘러싼 사성(莎城)이 조성되어 있다.
