피고인은 2015. 5. 13. 16:30경 서울 강북구 B에 있는 피해자 C이 운영하는 ‘D’에서, 피고인이 전날 피해자의 가게에서 통닭을 샀는데 피해자가 무를 주지 않았다는 이유로 화가 나, 피해자에게 “씹할년”이라고 욕설을 하면서 손으로 피해자를 때릴 듯한 시늉을 하고 진열되어 있던 무를 바닥에 던지는 등 약 30분 동안 행패를 부려 위력으로 피해자의 식당 운영 업무를 방해하였다.
