In light of the records, the court below's rejection of the defendant's assertion about the mental disorder on the grounds of its stated reasoning is just, and there is no error of misapprehension of the legal principles or misconception of facts due to violation of the rules of evidence, without examining the mental disorder as alleged in the grounds of appeal.

In addition, considering various circumstances, including the Defendant’s age character and behavior intelligence and environment, relationship with the victim, motive means and consequence of the instant crime, and circumstances after the crime, there are substantial grounds to recognize that the lower court’s determination of the sentence was extremely unfair, which maintained the first instance judgment that sentenced 12 years of imprisonment to the Defendant even when considering the circumstances asserted by the Defendant.
