A defendant shall be punished by imprisonment for not more than ten months.

Punishment of the crime

The Defendant, from August 2015 to June 2019, managed the Idong, Fdong, G Dong and the same building owned by the victim C located in B from around 2015 to around 2019, performed the role of receiving lease deposit and rents from the lessee in lieu of the victims and delivering them to the victims. The Defendant, as the managing director, was engaged in the duties such as paying the lease deposit and rents on behalf of the lessee of the said D building by requesting the payment of gas costs from the lessee of the said D building on behalf of the victim.

1. Around December 21, 2015, the Defendant, at the office of the head of the office of the office of the management office of the foregoing D building, concluded a real estate lease agreement with Nonindicted J as to subparagraph K of the said D building, received cash payment of KRW 2,400,000 as a monthly rent for six months, and had been in the custody for the victim C, and had been voluntarily consumed from the day of the Chungcheong City Council at the time of the voluntary consumption for personal use by the victim C, and from that time until June 19, 2019, the Defendant arbitrarily consumed KRW 93,090,000 in total on 25 occasions, as shown in attached Table 1.

Accordingly, the Defendant embezzled the property of the victim C and the victim H in the course of business.

2. On March 2019, the Defendant received 68,460 won in cash from the victim’s victim’s failure to pay urban gas fees in lieu of urban gas fees at the office of the head of the building management office, and received a total of 133,790 won from around that time to June 2019, and used the same for personal purposes at around that time while working for the victim.

In addition, the defendant was issued 4,423,930 won in total from July 2017 to June 2019 by the same method 16 times as shown in the annexed Table 2 of Crime List.
