A defendant shall be punished by imprisonment for one year.
Reasons
Punishment of the crime
From May 2014 to May 10, 2019, the Defendant is an accounting staff member of the B apartment autonomous committee (representative C) of the Chungcheong City from May 2014 to May 10, 2019, who was engaged in the management and execution of the funds of the victim, such as management expenses paid from B apartment residents.
1. The Defendant, from May 10, 2016 to May 23, 2019, received management expenses from the aforementioned B apartment occupants in the bank account (E) in the name of the Defendant and was in custody of the victim. Around June 17, 2016, the Defendant withdrawn KRW 150,000 from the cash automatic machine located in the place of mountainous districts for the use of the association located in Chungcheong City, Chungcheongnam-si, and then consumed them for personal use at around that time, and then arbitrarily consumed them for personal use by withdrawing KRW 88,540,70 in total over 287 times from May 9, 2019, as indicated in the attached Table 1 of the Crimes List from the day of Chungcheong City to May 9, 2019.
2. On May 2016, the Defendant arbitrarily consumed KRW 519,010 of the management expenses, which was collected in cash from the aforementioned B apartment occupants and was in custody for the victim, for the personal use of KRW 36,412,226, total sum of KRW 19,412,226, as shown in the attached Table 2, from around the time of the shocking to April 2019, while the Defendant received management expenses in cash from the said B apartment occupants and was in custody for the victim.
3. The Defendant embezzled KRW 70% or KRW 80% of the electric charges for security lights installed in B apartments with subsidies from the Chungcheong City to C, the representative of the said apartment autonomous committee, and had it transferred from C to the Defendant’s Hassociation account (I) and had it used for personal purposes while keeping it for the victim.
On December 14, 2017, the Defendant withdrawn 300,000 won from the cash automatic machines located in Yongsan-si, Chungcheongnam-si, and then personalized according to the mind of the Defendant around that time.
