A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Criminal facts

The Defendant is a person who operates a billiard room in the name of “C party room” on the 3th floor of Changwon-si, Magwon-si B building.

No one shall engage in speculative acts as a business by using slot or speculative gaming machines, other than speculative business, and shall provide the game water for use or exchange the tangible or intangible results obtained by using the game water that is not classified by the Game Water Management Committee.

1. Crimes from May 2, 2017 to June 8, 2017:

A. From May 2017 to June 02:20 to June 8, 2017, the Defendant: (a) set up four types of speculative business in the instant billiard room; and (b) set up four types of speculative electronic instruments, which visited the pertinent billiard room, and had many unspecified customers visiting the said billiard room play a game; and (c) converted the points obtained by customers into KRW 1,000 per 50 per 50 points.

Accordingly, the defendant was engaged in speculative activities using speculative gaming machines as a business.

B. The Defendant, at the time and place specified in the foregoing paragraph A. At the time and place, set up four boxes of “mail posters” game not classified by the Game Water Management Committee, and allowed many unspecified customers who visited the above billiard room to use the said game machine.

As a result, the defendant provided game water that was not classified as a rating for use.

The Defendant, at the time and place specified in the above A. At the same time and place, set up four boxes for the “Physical Mwitter” game, let many and unspecified customers play the game, and, depending on the result, converted the points to KRW 1,000 per 50 points, exchanged the points obtained by customers in cash.

As a result, the defendant carried out money exchange business through the use of game water.

2. From July 2017 to August 7, 2017, the crime committed from around July 201 to August 16:37.
