1. The part of the judgment of the court of first instance against the Defendants shall be revoked, and the Plaintiff corresponding to the revoked part shall be against the Defendants.
Reasons
1. Basic facts
A. The relationship 1) The Plaintiff, the Defendants, and F are the holders of the ownership transfer registration on the instant land’s share (the Plaintiff’s share 54/228, Defendant B’s share 57/228, F’s share 57/228, Defendant C’s share 3/228, Defendant D’s share 27/228, and Defendant D’s share 27/228), and the Defendants and F are the owners of each section of exclusive ownership on the land other than the instant land, which is an aggregate building.
(B) The instant building among the instant land is located on the ground of 10,11, 3, 12, 5, 6, 7, 16, 17, 17, and 10 square meters, connected in order to the appraisal of the instant land. (B) The instant land was owned by G, while G sold it to H, and H sold to I, and I completed the registration of ownership transfer on October 31, 1987.
2) I divided the instant land into co-ownership and sold it to M, K, J, and L respectively. M divided the 33/28 shares out of the instant land on July 25, 198; K divided the 57/228 shares out of the instant land on October 13, 198; L divided the 81/228 shares out of the instant land on October 29, 198; J completed the registration of ownership transfer as to the 57/228 shares out of the instant land on November 14, 198; L divided the 81/228 shares out of the instant land into 27/28 shares and 54/228 shares, and sold them to H.
H Sale shares above 27/228 to O, while H sold to Defendant C, H completed the registration of ownership transfer on June 8, 1990,O on November 26, 1992, and Defendant C on March 23, 1996.
On the other hand, L sold the remaining 54/228 shares to the Plaintiff, and the Plaintiff completed the registration of ownership transfer on May 19, 2004.
4 On November 19, 1990, K had completed the registration of ownership transfer with respect to the land share ownership of this case under its own name to F, and J on April 11, 2002 to Defendant B, and M’s land share of this case was N on April 200.
