Defendant
A shall be punished by a fine for negligence of KRW 6,000,000, and by a fine of KRW 2,000,000.
The above fine is imposed against the Defendants.
Reasons
Punishment of the crime
1. The Defendant is a person holding a two-wheeled motor vehicle that bears half of the costs when purchasing a two-wheeled motor vehicle with B and B on November 2017, and is engaged in driving a two-wheeled motor vehicle without mandatory insurance.
On November 10, 2017, the Defendant driving the said two-wheeled vehicle without obtaining a driver’s license of a motor vehicle on November 10, 2017, with a blood alcohol concentration of 0.148%, and driving the two-wheeled vehicle at a speed that makes it impossible to identify three-lanes of the road in front of Incheon Seo-gu, Seo-gu, by driving the said two-wheeled vehicle under the influence of alcohol concentration of 0.148%.
Since there is an intersection where signal lights are installed, in such a case, the driver has a duty of care to observe the signal and safely drive the signal in accordance with the signals.
Nevertheless, the Defendant neglected this and received the front part of the Estststuna taxi driving in the direction of the two-wheeled vehicle as the front part of the said two-wheeled vehicle, which was driven by the Eststuna taxi, to make a left-hand turn at the first lane of the opposite part due to the negligence going in contravention of the signals of the stop line.
Accordingly, the Defendant, while under the influence of alcohol, driving the said two-wheeled vehicle without a driver’s license, and driving the said two-wheeled vehicle while it is difficult to walk due to the influence of alcohol and it is difficult to drive the vehicle normally due to snow, etc., and inflicted injury on the victim F, who is the passenger of the said rocketing si, such as the chill and tension of the said part requiring approximately two weeks of medical treatment, and the chill and tension of the said part requiring approximately two weeks of medical treatment to the victim G, who is the passenger of the said rocketing si, in need of approximately two weeks of medical treatment.
