Defendant shall be punished by a fine of KRW 5,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

On March 11, 2011, the Defendant received a summary order of KRW 3 million from the Seoul Central District Court due to a violation of the Road Traffic Act.

Despite the fact that the Defendant had been in violation of the provision on the prohibition of driving under the influence of alcohol once or more times, the Defendant driven a DNA brea on January 8, 2020, when he was under the influence of alcohol at approximately 0.033% of the blood alcohol concentration in the section of approximately 200 meters from the Do adjacent to the Busan-si B market to the Do in the front of Busan-si.

Accordingly, the Defendant violated the prohibition of driving under the influence of alcohol not less than twice.

The grounds for sentencing under Article 334(1) of the Criminal Procedure Act for the order of provisional payment are all recognized, and the punishment shall be determined by taking into account all the sentencing conditions shown in the pleadings of the instant case, such as the number of blood alcohol concentration, driving distance, the frequency and time and interval of the crime, the family relation, age, character and conduct, environment, circumstances of the crime, and circumstances after the crime.
