노인복지법 시행규칙(제22조 제1항, 별뵤4의 제6항)에 따르면, 입소자가 30명 이상인 시설의 경우 입소자 2.5명당 요양보호사 1명, 물리치료사 1명, 간호(조무)사 1명, 사회복지사 1명, 입소자 50명 이상인 경우 영양사 1명을 배치하여야 함 . 노인장기요양보험법에 의하여 직원 1인의 월 근무시간이 160시간 이상인 경우 1인으로 계산하고, 동일 직종에 종사하는 직원 중 1인으로 계산되지 아니한 직원의 근무시간은 합하여 계산하는 등 직원배치 기준의 충족 여부에 따라 그 배치 기준이 충족되었을 경우, 공단은 입소자의 장기요양등급 및 급여제공일수를 기준으로 매월 급여비용을 산정하여 장기요양기관 운영자에게 100% 지급해 주고 있다.
