1. The plaintiff's claim is dismissed.

2. The costs of lawsuit shall be borne by the Plaintiff.

1. Basic facts

A. The Plaintiff is an insurer who entered into an automobile insurance contract with Nonparty E on the F Salary Truck (hereinafter “instant accident vehicle”). The Defendant bears the duty of installing and managing signal apparatus on the road, which is the place where the following accident occurred.

B. On August 8, 2015, at around 13:40, the occurrence of a traffic accident: (a) around August 13:40, 2015, three lanes in front of G Apartment in Seoul Special Metropolitan City, Nowon-gu, were traveling along the speed of about 30 to 40 km in the direction of the city in the direction of the road direction from the street station; (b) around that time, the crosswalk was traveling along the crosswalk in front of the front of the Dowing License Test Station; (c) at the right edge of the instant accident, the pedestrian, who was a pedestrian who was standing on the left side of the instant vehicle, was able to find late the crosswalk, which was moving to the right side from the front side of the instant accident; and (d) again, the victim suffered an injury, such as a shock on the left side of the instant vehicle by shocking the victim with the wheels of the vehicle with the front side of the road.

On April 26, 2016, the Plaintiff paid 31,361,470 won in total to the treatment hospital, 38,000,000 won in terms of the amount of damage agreement, and 38,000,000 won in terms of the victim’s disability payment rate as the insurer for the instant accident vehicle, respectively, to the advisory panel (J and K) who provided medical advice for the purpose of calculating the victim’s disability payment rate, as the medical advisory cost (i.e., 150,000 won x 2).

1) At the time of the instant accident, even though the accident was low at the time of the instant accident, there was a large margin to the extent that the sudden view was not properly visible, and the signal apparatus installed at the location of the instant accident (hereinafter “instant signal apparatus”).

The signal lights have not been operated in a state where all the cars and pedestrians are boomed due to heavy rain.
