A defendant shall be punished by imprisonment for not more than ten months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
On May 9, 2018, the Defendant: (a) around May 9, 2018, expressed an advertisement for the sale of psychotropic drugs published on the Internet (i.e., one philopon; hereinafter “philopon”); and (b) purchased a philopon from a seller of philopon [B’s “B”, “C”, and “E”, hereinafter)” (i.e., one psychotropic drugs published on the Internet, and (ii) intended to purchase and administer philopon from a mobile phone operator (B).
1. Purchasing philophones;
A. On May 9, 2018, at H convenience stores located in Seodaemun-gu Seoul Metropolitan Government, the Defendant transferred KRW 430,000 to the account (K) in the name of the said seller via ATM equipment in the name of the J bank (K) in the name of the said seller, and sent the deposit certificate to the said seller by the photographic seal.
Since then, the Defendant purchased a 0.05g gramopon contained in a transparent plastic package, which is located behind the signboard name of the road that the said seller informed of the house located in Seocho-gu Seoul Metropolitan Government as a photograph from the alleyway, around that time.
B. The Defendant around 21:30 on May 11, 2018, using ATM devices at the point of JAC CY located in Eunpyeong-gu Seoul Metropolitan Government M at the JAC AM station.
430,000 won was transferred to the J bank account in the name of the I as the pen and the deposit certificate was stamped to the seller.
Since then, the Defendant purchased a 0.05g gramopon contained in a transparent vinyl package, which is located behind the signboard name of the road that the said seller informed of the house located in Gangnam-gu Seoul Metropolitan Government N as a photograph from the alleyway, around that time.
C. At around 20:52 on May 24, 2018, the Defendant, at the location of JTM at the GTM headquarters located in Mapo-gu Seoul Mapo-gu Seoul, using ATM devices.
430,000 won was transferred to the J bank account in the name of the I as the pen and the deposit certificate was stamped to the seller.
After that time, the Defendant is the seller of the house located in Gwanak-gu in Seoul Special Metropolitan City P from the alleyway.
