A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

[2014 Highest 5105] Around April 18, 2014, the Defendant posted an advertisement letter stating that he/she “I sell an EXO performance pocket book” on a bulletin board by accessing Internet NAVV Kaca, despite having no intent or ability to sell performance pocket book, and then received KRW 400,000 from the victim C to the NA account (Account Number D) in the name of the Defendant’s name on the same day, and received KRW 1,350,000 from the above date to June 9, 2014 in the above manner, as shown in the attached Table 1, the Defendant received KRW 6 victims total of KRW 1,350,00 from the victims to the sales of performance pocket book.

Accordingly, the defendant was provided property by deceiving the victims.

Around April 24, 2014, the Defendant posted an advertisement letter stating that “I will sell performance pockets” on the bulletin board despite having no intent or ability to sell performance pockets, and then will have access to Internet NAV carbook and then received 300,000 won from the victim E to the NAC account in the name of the Defendant on the same day.

2. Around June 5, 2014, the Defendant posted an advertisement stating that “I will sell performance pockets” on a bulletin board despite having no intent or ability to sell performance pockets, and then will have access to the Internet NAV Roloc performance pockets,” and then acquired KRW 210,000 from the victim G to the agricultural bank account (Account Number F) in the name of the Defendant in the name of the Defendant on the same day.

[2014 Highest 6049] The Defendant, on June 25, 2014, did not intend or have the capacity to sell contact diskettes, sold '2014 Highest Contacts on the bulletin board by accessing Internet NAVV Kaca, while having no intention or capacity to sell contact diskettes.
