Defendants shall be punished by imprisonment for eight months.

However, with respect to Defendant A and B, for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

Defendant

A is the representative director of the “J Agricultural Partnership” in the “JA” located in the “YAU,” and Defendant B is the representative director of the “LAU,” located in the “YA,” and Defendant C operates “N,” which is the freezing equipment company located in the Heung-gu, Chungcheongnam-gu, Chungcheongnam-gu.

[Defendant C’s criminal records] On September 21, 2012, Defendant C was sentenced to a suspended sentence of 8 months of imprisonment for fraud in this court, and the judgment became final and conclusive on September 29, 2012.

【Criminal Facts】

1. On September 11, 2009, Defendant A and C’s joint criminal conduct JJ were selected as a subsidized business operator of “209 specialized product production, distribution and processing support project” from the head of Mansan-gun, and received subsidies from the head of Mansan-gun in order to newly build a low temperature storage and one unit of 161.49 square meters (49 square meters) at the Dansan-gun, Chungcheongnam-gun, Chungcheongnam-do.

The total construction cost of the construction of the above low temperature storage house is 126.4 million won. First of all, the subsidized business operator executed the 26.4 million won of the self-paid fund, and after the completion of the construction, the Dotsan Gun provided subsidies by the method of paying the 100 million won of the subsidy as the rest of the construction cost.

Nevertheless, the Defendants pretended that Defendant A did not first paid self-paid charges, and offered subsidies to cover the construction cost, thereby undermining the payment of the subsidies.

On December 2, 2009, the Defendants submitted an application for subsidies to the effect that the total project cost is KRW 126,400,000,000 except for KRW 26,400,000,000,000,000,000,000, to the public officials in charge of the distribution and distribution of the agricultural livestock products of the Nt. However, on November 2009, the Defendants entered into a contract to newly construct the construction cost of KRW 160 million by adding up approximately 49 square meters and 50 square meters at a collection center which is not subject to subsidies, and there was no specific contract with the said low temperature storage and the construction cost of KRW 126.4 million.

Accordingly, Defendant C is the defendant C.
