A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.

1. The Defendant is the actual manager of C in Kim Jong-si, who runs a manufacturing business with six full-time workers.

When a worker dies or retires, an employer shall pay the wages, compensations, retirement allowances, and all other money and valuables within fourteen days after the cause for such payment occurred.

Provided, That in special circumstances, the date may be extended by mutual agreement between the parties.

Nevertheless, the Defendant is working from January 4, 2013 to July 25, 2015 at the above workplace.

The retired D’s wages of KRW 13,829,09, including the total of KRW 5,771,494 and the total of KRW 8,057,60,094, including KRW 13,829,00,00,00 for retirement workers, were not paid respectively within 14 days from the date when the cause for payment occurred without an agreement on the extension of the due date between the parties.

When a worker dies or retires, an employer in violation of the Labor Standards Act shall pay him/her wages, compensations, retirement allowances, and other money or valuables within 14 days after the cause for such payment occurred.

Provided, That in special circumstances, the date may be extended by mutual agreement between the parties.

Nevertheless, the Defendant is working from August 3, 2015 to March 30, 2018, and from October 15, 2018 to June 21, 2019.

The retired E's wages, etc. total of KRW 17,239,772, including two retired workers, were not paid within 14 days from the date of occurrence of the reasons for payment without an agreement between the parties on the extension of the due date, as described in the attached Table 2, including KRW 1,552,716, March 2018.
