Reasons

Punishment of the crime

The defendant is the representative of Pyeongtaek-si building B and D, who is a full-time worker, and operates a service manufacturing business using six full-time workers.

1. "2018 Highest 850";

(a) When a worker dies or retires, the employer in violation of the Labor Standards Act shall pay the wages, compensations, and other money or valuables within 14 days after the cause for such payment occurred;

The Defendant, while working in the said workplace from January 1, 2013 to January 31, 2018, did not pay the retirement allowances of 14,597,40 won to 3 retired workers, including the retirement allowances of 14,597,40 won, and the total amount of 25,797,770 won of retirement allowances of 3 retired workers, within 14 days from the date of retirement without agreement between the parties on the extension of the due date.

2. "2018 Highest 1115";

(a) An employer violating the Labor Standards Act shall, in case where a worker retires, pay the wages, etc. within fourteen days after the cause for such payment occurred, unless agreed by the parties concerned;

Nevertheless, the Defendant, from October 19, 2015 to February 23, 2018, did not pay KRW 5,912,720,00,00,000, which was employed by the Defendant from around October 19, 201 to around February 23, 2018, within 14 days after the cause for the payment occurred without agreement between the parties.
