The judgment of the court below is reversed.

A defendant shall be punished by imprisonment for one year.

1. On April 17, 2016, the Defendant: (a) around 00:10, the Defendant: (b) while drinking alcohol in front of Seocheon-si Em-gu, Seocheon-si; and (c) was doing a dispute with the victim F (44 years old); and (d) was fluencing, the Defendant inflicted an injury on the victim’s left side, such as inside fin, fin, fin, etc. (hereinafter “the instant injury”); (c) caused the victim to the unknown real name of the face.

2. The judgment of the court below

A. Facts of recognition 1) The Defendant, the victim, and the related Defendant were only familiar with the victim with the same company fees of the same eight years prior to the date of the occurrence of the crime. G was the same as the victim and the high school, and became aware of the Defendant through the victim from the day before seven to eight years.

2) Around 17:40 on April 16, 2016, the Defendant, the victim, and the Defendant of G, the Defendant of G, and the Defendant of G, both with the victim, and the victim, and the Plaintiff, in the I cafeteria located in the first-lane D in the second-lane D, and the Plaintiff, at the home, 4 C in the second-lane D, in the second-lane D, and 15 in the third-lane K bar in the third-lane JV., the Defendant drank all of the three-lanes in excess of their own alcohol.

3) The Defendant, the victim, and the G were met before and after the instant injury, and were unable to clearly memory the situation before and after the instant injury, and the contents identified as surrounding CCTV are as follows.

① On April 16, 2017, the Defendant: (a) 23:56 around 23:56, while leaving a singing club and getting on and off an elevator at the entrance of the Defendant; and (b) around 23:59 on the same day, the victim landed from a singing club and getting on and off the elevator with the first floor.

While the Defendant and the victim talked at the entrance of the first floor, G landed to the first floor of the building around 00:00 on April 17, 2017, and three persons dialogueed at the entrance of the building, and all around 00:02 on the same day she walk out of the building.

② On April 17, 2016, G 00:02, G used a way to walk in front of a cafeteria, which is a building adjacent to a singing club, in Bupyeong-gu, Seoul Special Metropolitan City (Seoul Special Metropolitan City). On the other hand, the Defendant is leading to a mountain, while the victim is leading to a mountain.
