피고인은 B, C와 공동하여, 2016. 10. 28. 01:30경 부산 부산진구 D에 있는 'E마트' 앞에서 성명불상의 일행들과 함께 도박(일명 짤짤이)을 하던 중 피해자 F(63세)이 ‘노름을 하지 말라’고 하였다는 이유로 시비가 되어 피고인은 피해자의 멱살을 잡고 주먹으로 얼굴을 수차례 때리고 발로 피해자의 등을 밟으며 얼굴을 차고, B은 이에 가세하여 피해자의 멱살을 잡고 주먹으로 피해자의 얼굴을 수 회 때리고, C는 피해자의 멱살을 잡고 목을 조르고 피해자를 밀쳐 넘어뜨리는 등 폭행하였다.
