피고인은 2015. 7. 12. 09:40경 서울 관악구 B고시원 3층 출입문 앞 복도에서 위 고시원 원장 피해자 C이 거주자들의 실내 흡연 문제를 해결해 주지 않는다는 이유로, 고시원 거주자 D 외 5 내지 6명이 있는 자리에서 피해자에게 “썅년, 이년은 인간이 아니다”, “이년이 저년이 나쁜 년이 인간이 아니다”라고 하는 등 욕설을 하여 공연히 피해자를 모욕하였다.
