Defendant

A shall be punished by a fine for negligence of KRW 1,500,000, and by a fine of KRW 3,000,000.

The Defendants respectively.

Punishment of the crime

1. Defendant A

(a) Any person who violates the Food Sanitation Act shall report to the competent authorities on his/her general restaurant business;

Nevertheless, Defendant A did not report to the competent authorities, and from July 9, 2015, Defendant A did not report the same year.

9. 9. 경까지 서울 금천구 C 건물 앞 D 역 5번 출구 앞 도보 위 노상에서 음식물 조리시설을 갖추고 테이블 5개 ~6 개, 의자 15개 ~18 개 등을 설치한 후 손님들을 상대로 닭똥 집, 닭 발, 꼼장어, 산 낚지, 멍게 등을 조리하여 술과 함께 판매하여 1일 약 3~5 만원 상당의 매출을 올려 일반 음식점을 영업하였다.

(b) Any person who intends to occupy and use a road shall obtain permission from the competent authorities;

Nevertheless, Defendant A does not obtain permission from the competent authorities, and from July 9, 2015, Defendant A has the same year without obtaining permission from the competent authorities.

9. Until September 9, Geumcheon-gu Seoul Metropolitan Government Building: (a) had food cooking facilities on the front sidewalk No. 5 calendars in front of the entrance of the building, and occupied and used roads by installing 5 to 6 tables, 15 to 18 chairs.

2. Defendant B

(a) Any person who violates the Food Sanitation Act shall report to the competent authorities on his/her general restaurant business;

Nevertheless, Defendant B did not report to the competent authorities, and from July 9, 2015, Defendant B did not report the same year.

9. 9. 경까지 서울 금천구 C 건물 앞 D 역 7번 출구 앞 도보 위 노상에서 음식물 조리시설을 갖추고 테이블 3개 ~8 개, 의자 12개 ~32 개 등을 설치한 후 손님들을 상대로 떡볶이, 순대, 튀김류, 오뎅 등을 조리하여 술과 함께 판매하여 1일 약 15~28 만원 상당의 매출을 올려 일반 음식점을 영업하였다.

(b) Any person who intends to occupy and use a road shall obtain permission from the competent authorities;

Nevertheless, Defendant B did not obtain permission from the competent authorities, and from July 9, 2015, Defendant B had the same year.
