Reasons
Punishment of the crime
[2013 Highest 2721] On January 6, 2010, the Defendant made a false statement to the victim C, stating that “In order to sell cosmetics to door-to-door seller, it is necessary to purchase cosmetics, and thus, the Bank will pay interest as soon as possible and repay money.”
However, in fact, although the defendant was engaged in the cosmetics sales business, there was no substantial import, and there was no specific property other than five million won of lease deposit, and the E apartment and F apartment in the husband's name did not have the right to dispose of the E apartment and F apartment in divorce with the husband, so even if the defendant borrowed money from another person, he did not have the intention or ability to complete payment.
