A defendant shall be punished by imprisonment for one year.

However, the execution of the above punishment shall be suspended for two years from the date this judgment became final and conclusive.

Punishment of the crime

1. On September 13, 2014, the Defendant: (a) around 01:45 on September 13, 2014, at the “Eju store operated by the victim D” in Kimhae-si, the Defendant destroyed the damage by breaking the wind apparatus owned by the victim, which was in his/her place, in a dispute over the calculation of his/her daily behavior and drinking value; and (b) the police officers who continued to be dispatched to the scene upon receiving a report from the victim to check the damage on three occasions, and caused the damage to the victim, 4 glass cups owned by the victim were laid on the wall.

2. 특수공무집행방해, 상해 피고인은 제1항 기재 일시, 장소에서, 위와 같이 자신의 일행과 다투면서 D 소유의 물건을 손괴하던 중, 112신고를 받고 현장에 출동한 김해중부경찰서 기동순찰대 소속 경사 F가 위 3번방에 들어가 피해사항을 확인하는 사이에 소파에 앉아 유리컵을 벽에 던져 깨뜨리고, 이에 F가 피고인을 제지하자 "씹할놈아, 우짤긴데"라고 말하며 위험한 물건인 맥주병을 F를 향해 던져 깨뜨리고, F가 "하지마세요"라고 말하며 제지하려고 다가가자 다시 맥주병을 던지고 위험한 물건인 깨진 맥주병을 손에 들고 "뭘 하지마 씹할놈아"라며 F의 얼굴을 향해 휘둘렀다.

Accordingly, the defendant carried a shoulderer disease, which is a dangerous object, and interfered with the legitimate execution of duties by police officers concerning the control of crimes.

피고인은 이후 위 경찰서 소속 경위 피해자 G(47세)이 피고인을 위 E주점 앞 노상으로 데리고 나와 피고인의 행패를 제지하자 피해자에게 "왜, 씹할거, 마음대로 하면 되지, 너거 맘대로 해라, 마음대로 하면 될 거 아니가 씹할놈아, 개새끼 죽이삔다"라고 말하며 피해자의 왼쪽팔꿈치를 두 손으로 잡아당겨 뒤로 꺾고, 피해자가 오른손으로 피고인의 팔을 잡고 제지하자 피해자의 엄지손가락을 꺾어 피해자로 하여금 약 6주간의 치료가 필요한 좌측 상완...
