The prosecutor's appeal is dismissed.

1. Comprehensively taking account of the evidence submitted by the prosecutor, the court below erred by misapprehending the facts and adversely affecting the conclusion of the judgment on the part of the defendant, even though the court below found the defendant not guilty of the defendant, by spreading false facts that the victims have released advertising fees without permission by means of sending text messages, visiting text messages, or drawing up a text message “carphone”, thereby damaging the economic credibility of the victims and hindering their work.

2. Determination

A. The summary of the facts charged in the instant case is the complaint for CD branch offices, the issuing company of telephone number copies.

1. On May 2012, the Defendant’s credit damage: (a) at the office of the above C branch office located in Chuncheon-si, the Defendant: (b) there was no fact that the Victim FF Co., Ltd., the issuer of the competing telephone number book, and the victim H operating the G, its store, did not withdraw advertising fees without permission from its customers; (c) the contents of I’s articles reported around June 13, 2012, are in a case where the private telephone number book companies withdraw advertising fees without permission; and (d) there was a need for a careful attention in advertising in the telephone number book industry; (b) there was no fact that the victims were released advertising fees without permission, and there was a broadcast that the victims, including the advertiser, would inflict damage on the advertiser; (c) however, there was no fact that the victims were released from the phone numbers without permission; and (d) there was no fact that “the victims were released from the online numbers without permission by withdrawing the advertising fees without permission; and (d) there was no fact that the victims were damages caused by withdrawing the advertising news reports without permission.”
