1. Defendant shall be punished by a fine of KRW 4,900,000;

2. Where the defendant does not pay the above fine.

Punishment of the crime

The Defendant and the victim B (36 years old, female) are legally married couple in a divorce proceeding, and the Defendant is not a narcotics handler.

1. Violation of the Narcotics Control Act;

가. 피고인은 2017. 4. 9. 00:15 경 광주 북구 C 건물 1506호에 있는 피고인의 집에서 미리 소지하고 있던 향 정신성의약품인 졸 피 뎀 성분이 포함되어 있는 산 도스 졸 피 뎀 정 1 정을 가루로 빻아 맥주에 넣어 녹인 다음 이를 B에게 마시게 하려 하여 졸 피 뎀을 B에게 사용하려 하였으나, B이 이를 마시지 않아 미수에 그쳤다.

나. 피고인은 2017. 4. 11. 19:53 경 위 피고인의 집에서 미리 소지하고 있던 향 정신성의약품인 졸 피 뎀 성분이 포함되어 있는 산 도스 졸 피 뎀 정 1 정을 가루로 빻아 맥주에 타 녹인 다음 이를 B에게 마시게 하여 졸 피 뎀을 B에게 사용하려 하였으나, 맥주 안에 침전물을 발견한 B이 이를 마시지 않아 미수에 그쳤다.

2. On April 9, 2017, the quasi-indecent act Defendant attempted to use the Defendant’s stroke stroke m as set forth in paragraph 1(a) at the front door of the Defendant’s new wall, and tried to use the Defendant’s stroke m, but confirmed the Defendant’s attempted stroke m, and collected the Defendant’s hand into the victim’s panty m, thereby spreading the victim’s sound.
