1. Basic facts

A. On March 10, 2015, the Defendant filed a petition with the Intellectual Property Tribunal for a trial for invalidation of a patent against the Plaintiffs on March 10, 2015. The instant patent invention is a person with ordinary knowledge in the technical field (hereinafter “ordinary technician”).

2) On June 16, 2015, the Plaintiffs asserted that the nonobviousness should be invalidated on the grounds that the nonobviousness can be easily derived from prior inventions 1 through 4. The Plaintiffs asserted that the nonobviousness should be denied. (2) On June 16, 2015, where the said invalidation trial is pending, the claims 1 and 3 of the instant patent invention

(3) On November 7, 2016, the Intellectual Property Tribunal made a correction request to delete claims 2 as stated in paragraph (3) of the same Article, and on November 7, 2016, the Intellectual Property Tribunal rendered a trial decision to accept the above request for correction (hereinafter referred to as “the trial decision of this case”) on the ground that the Plaintiff’s request for correction is legitimate, but the claim 1, 3, 4, and 5 (hereinafter referred to as “claim 1”, and the remainder of the claims can be easily claimed from prior inventions 1 and 4 by a person with ordinary skills, and thus the inventive step is denied.
