A defendant shall be punished by imprisonment for three years.

However, the execution of the above punishment shall be suspended for five years from the date this judgment becomes final and conclusive.

Criminal facts

1. Around May 2009, the Defendant violated the Act on the Aggravated Punishment, etc. of Specific Economic Crimes (Fraud) submitted a business plan including “the current status of a person eligible for support for a local self-specific farming project (product)”, which stated that 13 persons, including E, etc., provide their own arable land as a business site and provided as if they were supported for a dance farming business in 2009, in order to apply for the designation of a business object under the “D-type dancing Agriculture Project” in the name of 11 members of the participating farmers, which is managed by Gyeonggi-do, in 2010. However, the above Defendant limited to those items recognized by the producer’s association such as farming, fisheries and livestock cooperatives, farming association, Si, Gun, and agricultural cooperatives, etc., which were managed by Gyeonggi-do, and submitted a business plan including “the current status of a person eligible for support for the development of local self-specific farming business (product)” in which 2010, which is included in the name of the Defendant’s individual-friendly farming group, etc.

The Defendant included a public official in charge in the foregoing manner, and around that time, the “Cheongcheon Ginseng Development System Construction Project,” which is a project proposal of D to support the above-affiliated farming business, was selected. On January 16, 2012, the Defendant submitted a request for a subsidy for the above clean ginseng cultivation system construction project at the office of the above Pocheon-si and Specialized Agricultural Team, and submitted a request for a subsidy to the said clean ginseng cultivation system construction project on January 17, 2012, and the corresponding amount is KRW 463,076,00 on January 17, 2012, and KRW 36,924,000 on February 28, 2012.
