The appeal is dismissed.
Reasons
The grounds of appeal are examined.
The lower court, on the grounds indicated in its reasoning, found all of the facts charged in the instant case (excluding the dismissal part of the prosecution) guilty.
The judgment below
Examining the evidence duly adopted by the first instance court, which maintained the reasoning of the lower court, there were errors in the misapprehension of legal principles as to “a statement of fact” in the crime of defamation, “a perception of false fact”, and mistake of law under Article 16 of the Criminal Act, contrary to what is alleged in the grounds of appeal.
subsection (b) of this section.
Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
