A defendant shall be punished by imprisonment for two years.

Punishment of the crime

On January 29, 2015, the Defendant was sentenced to one year and six months of imprisonment for fraud, etc. at the Seoul Eastern District Court on May 15, 2016, and the execution of the sentence was terminated.

Defendant 2265, on July 10, 2017, expressed that Defendant 320,000 won in cash would be sold to Defendant E, who reported and contacted with Defendant 320,000 won by using smartphones to sell Driart accommodation tickets in the Internet and trading website bulletin.

A false statement was made.

However, the defendant did not intend to sell the above goods.

As such, the Defendant, by deceiving the victim, received 320,000 won from the victim to the bank account of the name of the defendant on the same day.

In addition, from around that time to July 26, 2017, the Defendant received a total of KRW 2,90,000 from six times in the same manner as indicated in attached Table (i) and acquired the remittance.

1. On January 3, 2017, the Defendant: (a) on the Internet, posted a letter on the victim F’s online website, stating that “The Victim F seeks accommodation right” was sold with the victim’s contact; and (b) wired cash 120,000 won, the Defendant sold the said accommodation right.

A false statement was made.

However, the defendant did not intend to sell the above accommodation right.

As such, the Defendant, by deceiving the victim, received 120,000 won from the victim to the bank account of the name of the defendant on the same day, and acquired it by deceiving the victim.

2. On January 6, 2017, the Defendant, on the Internet, posted a letter on the victim H’s online website, stating that the victim H sought a right to accommodation, and if 2.30,000 won in cash is remitted to the victim, the Defendant would sell the said right to accommodation.

A false statement was made.

However, the defendant did not intend to sell the above accommodation right.

The defendant deceivings the victim as such, and is on the same day from the victim.
