A defendant shall be punished by imprisonment for not less than one year and six months.

Provided, That the execution of the above punishment shall be suspended for two years from the date this judgment became final.

Punishment of the crime

1. Around August 16, 2012, the Defendant violated the Punishment of Violences, etc. Act (a collective injury, etc., with deadly weapons) discovered that the victim E (the 53 years of age) who is a female living together with another male and female in the "D" head office located in Geumcheon-gu Seoul Metropolitan Government (the 53 years of age) drinks alcohol with other male and female, thereby causing a misunderstanding that he would escape from wind, and caused an injury to the victim, who was living together with a dangerous object on the table of the arbitr, resulting in a second-time medical treatment for about two weeks.

2. 재물손괴 및 상해 피고인은 2014. 3. 22. 22:20경 서울 금천구 F에 있는 피해자가 운영하는 ‘G’ 식당에서 술에 취하여 아무런 이유 없이 그곳에 비치되어 있던 피해자 소유의 식탁, 전기밥솥, 신용카드 단말기, 화분, 어항, 유리 그릇 등을 마구 집어던져 깨뜨리고, 이를 말리는 피해자의 얼굴 부분을 주먹으로 3회 때리고, 피해자가 맞지 않기 위해 식당 밖으로 도망가자 쫓아가 피해자의 머리채를 잡아챈 후 근처에 주차된 차량에 피해자의 머리 부분을 수회 내리찍고 땅바닥에 넘어뜨린 다음 피해자의 몸을 수회 밟고 피해자의 몸 위에 올라타 주먹으로 피해자의 얼굴 부분을 수회 때렸다.

Accordingly, the Defendant, as seen above, damaged the property owned by the victim by the market unmerchants, and inflicted injury on the victim, such as damage to the crocf that requires treatment for about two weeks.

3. On March 30, 2014, the Defendant: (a) around 18:40, the Defendant destroyed and damaged property by drinking out of a restaurant a cafeteria owned by the victim, which was kept in the said restaurant without any justifiable reason; (b) throwing out of the restaurant; and (c) taking the part of the table ridge on the floor, thereby destroying the property in the market.
