1. 피고인 B 피고인 B는 2013. 5. 2.경부터 2013. 5. 27.경까지 위 E게임장에서, 게임장을 임차한 후 게임물 명궁(CC-NA-130313-002호) 게임기 40대를 설치하여 위 게임장 손님들이 게임진행 순간 조이스틱이 화면 우측으로 이동되게끔 고정시킨 후 외부장치(일명 똑딱이)를 사용하여 발사버튼을 눌러 일정시간 및 일정구간이 지나면 자동으로 미션그림을 명중시켜 아이템카드를 획득하도록 함으로써 등급분류 받은 내용과 다른 내용의 게임물을 이용에 제공하였다.

2. 피고인 A 피고인 A은 피고인 B가 위와 같이 등급분류 받은 내용과 다른 내용의 게임물을 이용에 제공함에 있어 이를 돕기 위하여, 2013. 5. 26.경부터 2013. 5. 27.경까지 카운터를 보고 손님들에게 똑딱이를 나눠주는 등의 방법으로 그 범행을 용이하게 함으로써 방조하였다.
