A is a person who has operated the e-game place with the 2th floor in Gangnam-si D and the f1st floor in Gangnam-si, and the defendant B and the defendant C are an employee in the e-game place.

1 Defendant A

(a) No one shall exchange or arrange for exchange or repurchase of tangible or intangible results obtained through the use of game products by a person who conducts business of exchanging game products;

그럼에도 불구하고 피고인은 2017. 9. 15.경부터 2017. 10. 11.경까지 위 E게임장에서, ‘골드서브마린’ 게임기 40대를 설치하여 게임장 영업을 하면서, 그 곳을 찾아 온 불특정 다수의 손님들로 하여금 위 게임기에 현금을 투입한 다음 자동진행기(소위 ‘똑딱이’)를 이용하여 게임을 하게 하고, 그 결과 획득한 게임점수의 10%를 수수료 명목으로 공제한 후 돈으로 환전해 줌으로써 게임물의 이용을 통하여 획득한 결과물을 환전하는 행위를 업으로 하였다.
