A defendant shall be punished by imprisonment for not less than two years and six months.

To the defendant, the defendant shall complete the sexual assault treatment program for 40 hours.

Punishment of the crime

On April 8, 2017, the Defendant became aware of the Victim D (name, 8 years old, 17 years old) and became aware of the “C” smartphone-making display that was around April 8, 2017, and became a victim to communicate with the victim on April 9, 2017 while making contact with the victim.

1. A violation of the Act on the Protection of Children and Juveniles against Sexual Abuse (production, distribution, etc. of obscene materials) committed on April 9, 2017, from around 13:30 to 15:20, the Defendant taken the images of the Defendant and the victim’s sexual intercourse with the victim, taking advantage of the Defendant’s gallon photographing function of Samsung 8 mobile phone galloning gallon (S8 mobile phone shooting) in Samsung, which the Defendant was in possession of, during the period from around 13:30 to 15:20.

As a result, the Defendant produced obscene materials for children and juveniles.

2. Intimidation;

A. On April 11, 2017, the Defendant: (a) asked the victim to engage in dial-a-a-a-the-spot art, while talking with the victim at around 07:02 on April 11, 2017, the Defendant: (b) stated that “A dial-ba-ba-ba-ba-ba-ba-ba-ba-ba-ba-ba-ba-ba-ba-ba-ba-ba-ba-ba-ba-ba-ba-ba-ba-ba-ba-ba-ba-ba-ba-ba-ba-ba-ba-ba-ba-ba-ba-ba-ba-ba-ba-g-g

ㅋㅋ 씹으면 안될 텐데’ 라는 취지로 말하여 마치 피해 자가 거부할 경우 피해자와 성관계 당시 촬영한 동영상을 유포할 것처럼 겁을 주어 피해자를 협박하였다.

나. 2017. 4. 13. 자 협박 피고인은 2017. 4. 13. 11:02 경 불상지에서 피해자와 G으로 대화를 하던 중 피해자에게 섹스 노예를 할 것인지를 물어보면서 피해자가 거부하는 취지로 말하자 ‘ 알아서 생각해 라, 암튼 수고 해봐, 겪어 봐, 동영상이 좀 걸리시나 ㅎㅎ, 알았어
