1. The Defendant’s KRW 58,169,00 for the Plaintiff and 6% per annum from March 20, 2013 to September 16, 2014.
Reasons
1. Facts of recognition;
A. Upon the expiration of October 20, 2009, the term of lease with C pertaining to Nos. 106, 201, 201, Suwon-si, Suwon-si, Suwon-si, the Plaintiff: (a) delegated the conclusion of the lease contract with E, the representative of the licensed real estate agent office, with the term of lease with C, which is related to the building No. 106, 201 (hereinafter “the loan of this case”).
B. F’s brokerage working as E’s brokerage assistant at the D Licensed Real Estate Agent Office, and the Plaintiff entered into a lease agreement with G on September 7, 2009, setting the lease deposit amount of KRW 80,000,000, and the lease term of this case by October 20, 201, and E entered the name and seal of the principal in the brokerage column of the said contract.
C. Meanwhile, on the other hand, with respect to H on December 10, 2009 and the loan of this case as the broker of the above F, G entered into a sublease contract with 10,000,000 won for the sublease deposit, 50,000,000 won for the rent, and the sublease period until December 24, 2011, and the name and seal of E was also affixed to the broker of the said sublease contract.
F. Around July 2010, G requested the introduction of a new lessee of the instant sub-lease on its behalf of the Plaintiff or G, who is the representative of the I Licensed Real Estate Agent Office, contacted K to rent the instant sub-lease from J. On the other hand, K was willing to act as a broker for the instant sub-lease on behalf of the Plaintiff or G.
Accordingly, at the I Licensed Real Estate Agent Office operated by J on July 12, 2010, the J, K, and F drafted to K a lease agreement with the Plaintiff setting the lease deposit amount of KRW 80,00,000, and the lease term of the instant loan up to July 31, 2012 (hereinafter “instant lease agreement”); and the J entered the lessor’s resident registration number, telephone number, and name at the bottom of the lessor’s column of the said agreement into the leased agreement, and affixed the seal of E brought to the F, and the lessee’s column.
