Reasons
Punishment of the crime
around March 15, 2005, Gangwon-do added the competitiveness through the creation of new demand for consumption through the commercialization of export flowerss, and subsidized the installation of E in order to enhance added value and export promotion by small packaging reflecting the demand for consumption of exporting countries, and Pyeongtaek-gun subsidized the installation of E in order to promote added value and export promotion. This year upon receipt of an application for the said project from the Defendant A in the name of “FFF Cooperative”.
5.6. Around October 27 of the same year, the FF Farming Cooperative was selected as a subsidy business entity, and the subsidy business entity was approved by the change in the name of G on October 27 of the same year, and as a result, G was ultimately entitled to a subsidy of KRW 220,400,000,000 from Gangwon-do and Sejong-gun.
1. Defendant A is the representative of “G”.
On July 29, 2005, the Defendant embezzled by arbitrarily selling the amount equivalent to KRW 35,00,000,000 at the market price of the truck under the name of the FF Farming Cooperative, which was a subsidy received as above, to K at will around November 11, 2010.
2. Defendant B, upon reporting to the press due to lack of follow-up management on the above subsidy program, failed to prepare a false management ledger.
Around July 30, 2011, the Defendant entered the facts in the office L and the office of the Pyeongtaek-gun Agricultural Technology Center L and the office of the Pyeongtaek-gun, Pyeongtaek-gun, Changwon-gun, Kim Chang-gun, in the records of production and sales of the above subsidy, “Bcare, ste, Pu, Test products, public relations,” in the records of “Bcare, sap, Pu, Test products, public relations,” in the records of “07 performance” in the records of “Bcare, Pream Experience Center, Emb, gift,” and “10 actual records” in the records of “Bcare, Scam, Emb, Publicity, Publicity, gift,” and “10 actual records” in the records of “06 management and operation.”
